3 common scenarios that could lead to a solid FELA claim

Railroad employees face unique challenges on the job, and understanding the Federal Employers’ Liability Act is important for ensuring the protection of their rights.

FELA provides a legal avenue for compensation when injuries occur due to employer negligence. Some common situations can form the basis of a solid FELA claim.

1. Unsafe working conditions

Railroaders often encounter hazardous working conditions that can lead to serious injuries. If an employee can demonstrate that their injury resulted from unsafe working conditions caused by the employer’s negligence, they may have a strong FELA claim. Examples include poorly maintained equipment, lack of safety protocols, or inadequate training.

2. Failure to provide adequate safety equipment

Railroad work involves operating heavy machinery and handling powerful tools. Employers are responsible for providing appropriate safety equipment to minimize the risk of injury. If a railroader sustains an injury due to the absence or malfunction of safety gear, such as protective clothing, helmets or safety harnesses, it may constitute grounds for a FELA claim.

Although the injury rate for railroad workers dropped 59% since 2000, accidents still happen. By recognizing common incident scenarios, railroaders can take proactive steps to protect their rights and seek compensation for injuries resulting from employer negligence.
